Na sua principal obra política, os _Dois Tratados Sobre o Governo_, Locke defende o direito do indivíduo de resistir ao soberano. Entretanto, segundo Locke, o ser humano abandona o estado de natureza voluntariamente para criar o Estado político com a esperança de que o poder político amenize as inconveniências do estado de natureza. Se a criação do Estado político foi voluntária, em que circunstâncias se deve resistir às determinações do soberano? Além disso, como fundamentar o direito de resistência ao soberano (...) que foi instituído com a permissão do próprio indivíduo que agora pretende resistir as suas determinações? O objetivo do presente texto é discutir os motivos pelos quais a defesa do direito de resistência se torna necessária no pensamento político de Locke, e de que forma e com quais fundamentos Locke defende tal direito no _Segundo Tratado Sobre o Governo_. Pretende-se reconstruir o argumento de Locke em defesa do direito de resistência a partir da análise da referida obra e seu contraste com o _Patriarcha _; do contexto histórico e de alguns dos seus principais comentadores.Ainda que, segundo Locke, o Estado tenha surgido para proteger os direitos individuais como a liberdade e a propriedade, o governante está sujeito a se corromper e utilizar sua posição para praticar a injustiça contra seus súditos. O direito de resistência, apoiado na lei da natureza que permanece em vigor mesmo no estado civil, é o último recurso dos indivíduos contra a tirania praticada pelo governante corrompido. (shrink)

Em Anarquia, Estado e Utopia, Robert Nozick defende um Estado mínimo ao qual não deve ser dado o direito de redistribuir a propriedade que já foi distribuída pelos individuos. Nozick se apoia na ideia de estado de natureza tal como Locke propôs no Segundo Tratado Sobre o Governo, aproveitando, inclusive, a maneira de Locke fundamentar a propriedade privada. Locke explicou o direito natural à propriedade por meio do trabalho para superar uma crítica que Robert Filmer havia dirigido a Hugo Grotius (...) anos antes. Grotuis considerava haver, originalmente, um direito comum à posse dos bens e defendia que a propriedade privada surgiu a partir de um contrato entre os indivíduos. Filmer colocou em dúvida que um contrato para dividir a propriedade pudesse ter sido firmado entre todos ao mesmo tempo. Locke também defendia a propriedade privada a partir da propriedade comum, mas precisava superar a objeção que Filmer havia dirigido a Grotius. Nesse sentido surge a ideia de trabalho como fundamentador da propriedade privada, pois é o trabalho que a legitima em vez do contrato. Nozick, apesar de uma longa análise sobre a teoria da aquisição de Locke, em que discorre, inclusive, sobre o papel do trabalho no surgimento da propriedade privada, afirma que Locke pensava os bens naturais originalmente sem dono, quando, na verdade, para Locke eles eram propriedade comum a todos. O propósito do presente texto é elencar e avaliar algumas possíveis consequências desse pequeno equívoco interpretativo. (shrink)

It is still a widespread assumption that metaphysics and ontology deal with roughly the same questions. They are supposed to be concerned with the fundamental nature of reality and to give an account of the meaning of 'existence' or 'being' in line with the broadest possible metaphysical assumptions. Against this, Markus Gabriel proposes a radical form of ontological pluralism that divorces ontology from metaphysics, understood as the most fundamental theory of absolutely everything. He argues that the concept of existence (...) is incompatible with the existence of the world and therefore proposes his innovative no-world-view. In the context of recent debates surrounding new realism and speculative realism, Gabriel also develops the outlines of a realist epistemological pluralism. His idea here is that there are different forms of knowledge that correspond to the plurality of fields of sense that must be acknowledged in order to avoid the trap of metaphysics. (shrink)

A semantics of pictorial representation should provide an account of how pictorial signs are associated with the contents they express. Unlike the familiar semantics of spoken languages, this problem has a distinctively spatial cast for depiction. Pictures themselves are two-dimensional artifacts, and their contents take the form of pictorial spaces, perspectival arrangements of objects and properties in three dimensions. A basic challenge is to explain how pictures are associated with the particular pictorial spaces they express. Inspiration here comes from recent (...) proposals that analyze depiction in terms of geometrical projection. In this essay, I will argue that, for a central class of pictures, the projection-based theory of depiction provides the best explanation for how pictures express pictorial spaces, while rival perceptual and resemblance theories fall short. Since the composition of pictorial space is itself the basis for all other aspects of pictorial content, the proposal provides a natural foundation for further pictorial semantics. (shrink)

Gabriel Richardson Lear presents a bold new approach to one of the enduring debates about Aristotle's Nicomachean Ethics: the controversy about whether it coherently argues that the best life for humans is one devoted to a single activity, namely philosophical contemplation. Many scholars oppose this reading because the bulk of the Ethics is devoted to various moral virtues--courage and generosity, for example--that are not in any obvious way either manifestations of philosophical contemplation or subordinated to it. They argue that (...) Aristotle was inconsistent, and that we should not try to read the entire Ethics as an attempt to flesh out the notion that the best life aims at the "monistic good" of contemplation. In defending the unity and coherence of the Ethics, Lear argues that, in Aristotle's view, we may act for the sake of an end not just by instrumentally bringing it about but also by approximating it. She then argues that, for Aristotle, the excellent rational activity of moral virtue is an approximation of theoretical contemplation. Thus, the happiest person chooses moral virtue as an approximation of contemplation in practical life. Richardson Lear bolsters this interpretation by examining three moral virtues--courage, temperance, and greatness of soul--and the way they are fine. Elegantly written and rigorously argued, this is a major contribution to our understanding of a central issue in Aristotle's moral philosophy. (shrink)

We analyze the geometric foundations of classical Yang-Mills theory by studying the relationships between internal relativity, locality, global/local invariance, and background independence. We argue that internal relativity and background independence are the two independent defining principles of Yang-Mills theory. We show that local gauge invariance -heuristically implemented by means of the gauge argument- is a direct consequence of internal relativity. Finally, we analyze the conceptual meaning of BRST symmetry in terms of the invariance of the gauge fixed theory under general (...) local gauge transformations. (shrink)

This article seeks to contribute to a vision for leadership in business based on a recovery of virtue. The vision for leadership articulated here draws principally on the writings of the classical philosopher Aristotle and of the contemporary philosopher Josef Pieper. Without discounting the ever-increasing complexity of modern business, this essay will attempt to reconstruct Aristotle’s emphasis on virtue and moral character, and argues for the philosopher’s relevance to modern management and corporate leadership. The paper concludes that the message of (...) virtue is a message of hope and attempts to find plain language to articulate its value to those engaged in business or concerned with the formulation of government policy. This paper presents a new version of the democratic argument for the freedom of expression that has the resources to give a plausible reply to the perennial objection—ordinarily considered fatal—that such accounts fail to deliver protections for abstract art, instrumental music, and lots of other deserving nonpolitical speech. The argument begins with the observation that there are different things that a free speech theory might aim to accomplish. It will hope to justify a right to free speech, of course, with (...) a particular scope and shape, but that right might be a moral right, an ordinary legal right, or a specifically constitutional right. The new version of the argument—the refined argument from democracy—aims to justify a specifically constitutional right to political speech, administered by strong-form judicial review. The democracy theorist can accommodate the intuition that abstract art deserves protection by agreeing that we have a moral right, and probably ought to have an ordinary legal right, to produce and view abstract art. She must only insist that abstract art should not be protected by a specifically constitutional right administered by strong-form judicial review. Not because abstract art does not deserve constitutional protection, but because, on this view, whether a particular right ought to be enshrined in the constitution and administered by judicial review is not solely a matter of the importance of the right or the value of the interests it protects. In this paper, I first explore Hegel’s own distinctions between various types of idealism, most of which he explicitly rejects. I discuss his notions of subjective, transcendental and absolute idealism and present the outlines of his criticisms of the first two as well as the motivation behind his commitment to a version of absolute idealism. In particular, I argue that the latter does not share the defining features of what is now commonly called ‘idealism’, as Hegel neither denies the existence (...) of an external world nor even holds that we can only somehow indirectly infer the truth of propositions about the external world from the structure of some given mental material. I give a basic account of what Hegel’s concept of ‘the absolute idea’ is about, which lies behind his absolute idealism. In this context, I maintain that it is crucial for our understanding of Hegel and of his potential relevance for contemporary metaphysics and epistemology that the absolute idea is precisely not a mental or ‘spiritual’ (geistig) entity. Rather, it amounts to a set of methodological assumptions designed to guarantee the overall intelligibility of what there is, regardless of its actual natural, social or more broadly normative structure. Sociologists often ask why particular groups of people have the moral views that they do. I argue that sociology’s empirical research on morality relies, implicitly or explicitly, on unsophisticated and even obsolete ethical theories, and thus is based on inadequate conceptions of the ontology, epistemology, and semantics of morality. In this article I address the two main problems in the sociology of morality: (1) the problem of moral truth, and (2) the problem of value freedom. I identify two ideal–typical approaches. (...) While the Weberian paradigm rejects the concept of moral truth, the Durkheimian paradigm accepts it. By contrast, I argue that sociology should be metaphysically agnostic, yet in practice it should proceed as though there were no moral truths. The Weberians claim that the sociology of morality can and should be value free; the Durkheimians claim that it cannot and it should not. My argument is that, while it is true that factual statements presuppose value judgments, it does not follow that sociologists are moral philosophers in disguise. Finally, I contend that in order for sociology to improve its understanding of morality, better conceptual, epistemological, and methodological foundations are needed. (shrink)

This essay calls attention to a set of linguistic interactions between counterfactual conditionals, on one hand, and possibility modals like could have and might have, on the other. These data present a challenge to the popular variably strict semantics for counterfactual conditionals. Instead, they support a version of the strict conditional semantics in which counterfactuals and possibility modals share a unified quantificational domain. I’ll argue that pragmatic explanations of this evidence are not available to the variable analysis. And putative counterexamples (...) to the unified strict analysis, on careful inspection, in fact support it. Ultimately, the semantics of conditionals and modals must be linked together more closely than has sometimes been recognized, and a unified strict semantics for conditionals and modals is the only way to fully achieve this. This pluralism is not relativistic but complementary. Different ways of knowing enrich each other thus facilitating a more comprehensive and differentiated conception of the world.".

Economic theory teaches that it is in every country’s interest to trade. Trade is a voluntary activity among consenting parties. On this view, considerations of justice have little bearing on trade, and political philosophers concerned with global justice should stay largely silent on trade. According to a very different view that has recently gained prominence, international trade can only occur before the background of an international market reliance practice shaped by states. Trade is a shared activity among states, and all (...) participating states have in principle equal claims to gains from trade. Trade then becomes a central topic for political philosophers. Both views are problematic. A third view about the role of trade in a theory of global justice is then presented, which gives pride of place to a notion of exploitation. The standard model of precedential constraint holds that a court is equally free to modify a precedent of its own and a precedent of a superior court—overruling aside, it does not differentiate horizontal and vertical precedents. This paper shows that no model can capture the U.S. doctrine of precedent without making that distinction. A precise model is then developed that does just that. This requires situating precedent cases in a formal representation of a hierarchical legal structure, and adjusting the constraint (...) that a precedent imposes based on the relationship of the precedent court and the instant court. This paper appeals to the phenomenon of dreaming to provide a novel defense against arguments from evil. The thrust of the argument is as follows: when we wake up after a nightmare we are often filled entirely with relief, and do not consider ourselves to have actually suffered very much at all; and since it is epistemically possible that this whole life is simply a dream, it follows that it is epistemically possible that in reality there is very little suffering. The history of the field of business ethics in the U.S. remains understudied and misunderstood. In this article I begin to remedy this oversight about the past, and I suggest how it can be beneficial in the present. Using both published and unpublished primary sources, I argue that the business ethics field emerged in the early twentieth century, against the backdrop of the establishment of business schools in major universities. I bring to light four important developments: business ethics lectures at (...) the University of California and Yale University, Leon Marshall’s curriculum at the College of Commerce of the University of Chicago, and the William A. Vawter Foundation on Business Ethics at Northwestern University. Then, I consider the payoffs of my historical account for business ethics theory, pedagogy, and practice. Specifically, I present four implications of my account under these headings: business ethics as a public problem; the place of ethics in business schools; historicizing business ethics; and historical self-knowledge. While some countries are moving toward legalization, euthanasia is still criticized on various fronts. Most importantly, it is considered a violation of the medical ethics principle of non-maleficence, because it actively seeks a patient’s death. But, medical ethicists should consider an ethical alternative to euthanasia. In this article, we defend cryocide as one such alternative. Under this procedure, with the consent of terminally-ill patients, their clinical death is induced, in order to prevent the further advance of their brain’s deterioration. Their (...) body is then cryogenically preserved, in the hope that in the future, there will be a technology to reanimate it. This prospect is ethically distinct from euthanasia if a different criterion of death is assumed. In the information-theoretic criterion of death, a person is not considered dead when brain and cardiopulmonary functions cease, but rather, when information constituting psychology and memory is lost. The primary objective of this book is to open space for rethinking the relationship between art and politics. It seeks to combat one of the fundamental assumptions that has plagued many of the previous debates on this issue: that art and politics are distinct entities definable in terms of common properties, and that they have privileged points of intersection, which can be determined once and for all in terms of an established formula. This common sense assumption is rooted in a (...) transcendent illusion according to which there are more or less fixed characteristics that unify our terms, concepts, and practices in such a way as to guarantee their meaning. Against this substantialist approach, Radical History & the Politics of Art argues for a praxeological account that begins the other way around by analyzing specific cultural practices without presupposing a conceptual unity behind them. Such an orientation is radically historicist in the sense that it recognizes that all of our practices—be they linguistic, theoretical, aesthetic or political—are historically constituted and that they are necessarily part of a temporal dynamic. Hence the contingent nature of the labels used to classify various practices or even identify ‘practice’ as such. Radical history thereby proposes a significant departure from the extant debates on art and politics by maintaining that there is no ‘art’ or ‘politics’ in general, nor a singular relation between them. There are only historically constituted practices in various conjunctures, some of which have been labeled, through practical acts of denomination, as ‘artistic’ or ‘political.’ Instead of proposing one more response to the oft-repeated question ‘what is the relationship between Art and Politics?’ this book seeks to overcome the presuppositions that plague such a question. It thereby changes the very nature of the investigation by asking: ‘how do the diverse aspects of practices identified as ‘aesthetic’ and ‘political’ overlap, intertwine and sometimes merge in precise socio-historical force fields of action? An exposition in five parts of the character of existentialist philosophy, including an analysis of the theories of Jean-Paul Sartre. Author Gabriel Marcel, a famous French dramatist, philosopher, and author of Le Dard, was a leading exponent of Christian existentialism.

We present two studies investigating the impact of causal perceptions and the moral emotions of anger, shame, and guilt on the justification of deviant workplace behavior. Study 1 tests our conceptual framework using a sample of undergraduate business students; Study 2 examines a population of practicing physicians. Results varied significantly between the two samples, suggesting that individual and contextual factors play an important role in shaping the perceptual and emotional processes by which individuals form reactions to undesirable affective workplace events. In this paper I examine the relation between modern transhumanism and Nietzsche’s philosophy of the superhuman. Following Loeb, I argue that transhumanists cannot claim affinity to Nietzsche’s philosophy until they incorporate the doctrine of eternal recurrence to their project of technological enhancement. This doctrine liberates us from resentment against time by teaching us reconciliation with time and something higher than all reconciliation. Unlike Loeb, however, I claim that this “something higher” is not a new skill (prospective memory), but rather a (...) love for the past in the form of loving that aspect of it that is still with us, namely, the will to power itself, which is the engine of all life. Love of the past is thus equivalent to love of life. Since human beings are conscious incarnations of the will to power, in our case, love of life manifests itself as love of our humanity or love for that aspect of ourselves that connects us to each other, for we recognize it to be the same in all of us. Thus, learning this kind of love enables us to joyfully coordinate our wills in the pursuit of Zarathustra’s superhuman ideal without turning it into a destructive mockery of itself. While learning this kind of love would facilitate a joyful version of transhumanism, I conclude by suggesting that it is unlikely to be achieved through technological interventions of the sort envisioned by transhumanists. Instead, it requires the kind of participatory pedagogical program that Nietzsche thought his Zarathustra would fulfill. (shrink)

The financial crisis has led to new interest in the ethics of financial markets. In this article, we further the debate on the nature of banking contracts by showing that the fundamental subjective purposes of loan and deposit contracts are irreconcilable. Any resultant mixture of the two contracts is a legal aberration. We consider a mutual fund as an important and legitimate alternative to the common demand deposit to provide high liquidity and some yield without offering full availability of a (...) nominal sum. Besides being a close substitute for how many deposit accounts function today, the mutual fund has the additional benefit of satisfying all legal and ethical requirements. Loan and investment contracts allow for the “bank” to make use of their clients’ funds while the intents of money owners are clearly classified without running into legal or ethical problems. We propose a conceptual framework for understanding the relationship between observables and operators in mechanics. To do so, we introduce a postulate that establishes a correspondence between the objective properties permitting to identify physical states and the symmetry transformations that modify their gauge dependant properties. We show that the uncertainty principle results from a faithful—or equivariant—realization of this correspondence. It is a consequence of the proposed postulate that the quantum notion of objective physical states is not incomplete, but rather that (...) the classical notion is overdetermined. (shrink)

This paper explores several topics related to Woodin’s HOD conjecture. We improve the large cardinal hypothesis of Woodin’s HOD dichotomy theorem from an extendible cardinal to a strongly compact cardinal. We show that assuming there is a strongly compact cardinal and the HOD hypothesis holds, there is no elementary embedding from HOD to HOD, settling a question of Woodin. We show that the HOD hypothesis is equivalent to a uniqueness property of elementary embeddings of levels of the cumulative hierarchy. We (...) prove that the HOD hypothesis holds if and only if every regular cardinal above the first strongly compact cardinal carries an ordinal definable [Formula: see text]-Jónsson algebra. Although stakeholder theory is widely accepted in environmental disclosure research, empirical evidence about the role of stakeholders in firms’ disclosure is still scarce. The authors address this issue for a setting of carbon disclosure. Our international sample comprises the Carbon Disclosure Project Global 500, S&P 500, and FTSE 350 reports from 2008 to 2011, resulting in a total of 1,120 firms with 3,631 firm-year observations. The authors apply Tobit regressions to analyze the relationship between carbon disclosure and the relevance of (...) the following stakeholder groups: government, general public, media, employees, and customers. Our results confirm that in addition to carbon performance, all stakeholders are associated with carbon disclosure. Only one stakeholder group acts as a moderator for the relationship between carbon performance and carbon disclosure. Furthermore, the authors find that carbon performance but not the affiliation to a carbon-intensive industry acts as a moderator between stakeholder relevance and carbon disclosure. (shrink)

How much personal partiality do agent-centred prerogatives allow? If there are limits on what morality may demand of us, then how much does it permit? For a view Henry Shue has termed ‘yuppie ethics’, the answer to both questions is a great deal. It holds that rich people are morally permitted to spend large amounts of money on themselves, even when this means leaving those living in extreme poverty unaided. Against this view, I demonstrate that personal permissions are limited in (...) certain ways: their strength must be continuous with the reasons put forward to explain their presence inside morality to begin with. Typically, these reasons include non-alienation and the preservation of personal integrity. However, when personal costs do not result in alienation or violate integrity, they are things that morality can routinely demand of us. Yuppie ethics therefore runs afoul of what I call the ‘continuity constraint’. (shrink)

Moral repair is an important way for firms to heal moral relationships with stakeholders following a transgression. The concept is rooted in recognition theory, which is often used to develop normative perspectives and prescriptions, but the same theory has also propelled a view of moral repair as premised on negotiation between offender and victim(s), which involves the complex social construction of the transgression and the appropriate amends. The tension between normative principles and socioconstructivist implementation begs the question how offending firms (...) should approach moral repair. Addressing this question, we develop a two-level conceptualization of moral repair, distinguishing between procedural and substantive levels of practice, which accommodate normativity and socioconstructivism, respectively. In so doing, we enrich the literature by 1) promoting conceptual clarity, 2) refining understanding of the moral repair process, and 3) suggesting the use of a unified, configurational approach to studying (nonlinear) relations between amends and moral outcomes. This volume presents two works by Gabriel Marcel.

Many authors have argued that all studies of socially specific modalities of human action and experience depend on some form of “philosophical anthropology”, i.e. on a set of general assumptions about what human beings are like, assumptions without which the very diagnoses of the cultural and historical variability of concrete agents' practices would become impossible. Bourdieu was sensitive to that argument and, especially in the later phase of his career, attempted to make explicit how his historical-sociological investigations presupposed and, at (...) the same time, contributed to the elaboration of an “idea of the human being”. The article reconstructs Bourdieu's philosophical anthropology, starting with his genetic sociology of symbolic power, conceived as a form of critical theory, and concluding with an account of the conditio humana in which recognition appears as both the fundamental existential goal through which human agents strive to confer meaning on their lives and the source of the endless symbolic competition that keeps society moving. The agonistic vision of the social universe that grounds his sociological studies returns in his philosophical anthropology under the guise of a singular synthesis between Durkheim's thesis that “Society is God” and Sartre's idea that “hell is other people”. In this essay, we focus on Max Weber’s concept of rationalization to understand and make sense of the rise of bureaucratic, corporate governance and online learning in higher education. We reveal the distinct disconnect between human interaction and online platforms and how such disconnection is antithetical to higher learning. We also show how Weber’s analysis helps us recognize the uniquely crass commercialism embedded in the very rationalization that makes online learning in universities thinkable and actionable. Our use of online learning (...) is only one illustration of Weber’s concept of rationalization, but it provides an important understanding of the nefarious effects rationalization has on human interaction. The nexus of marketization, technology, and higher education represents, on our view, a juggernaut against faculty autonomy, academic freedom, and humane learning and should be directly challenged. One difficulty this challenge faces is the degree to which online learning has become ubiquitous and taken-for-granted. It has, as Weber clarifies, been rationalized. (shrink)
